The knife goes through a seedless watermelon the way an argument goes through a lazy afternoon: no resistance, no interruptions, nothing to spit. Somebody at the picnic table always ruins it. This summer the ruin arrives as a warning passed hand to hand across the internet: every seedless bite is a serving of your own impending death, because a fruit without seeds is a future without planting, and a future without planting is a population that eats only what it is sold. Subscribe to eat, the warning goes, or starve on schedule. The charge deserves a trial. Half of it is theater. The other half is the most important story in agriculture, and the theater keeps pointing at the wrong defendant.

Begin with the biology, because the biology settles the first count fast. A seedless watermelon is a triploid, a plant carrying three sets of chromosomes where fertility wants an even number. Hitoshi Kihara built the first ones in Japan, starting the work in 1939 and publishing “Triploid Watermelons” in the Proceedings of the American Society for Horticultural Science in 1951: treat an ordinary diploid melon with colchicine to double its chromosomes into a tetraploid, cross that tetraploid back to a diploid, and the offspring inherit the odd count. Three chromosome sets cannot pair off cleanly during meiosis, so the embryos abort, and the fruit fills with soft white seed coats that never harden into anything a person could plant. The seedless watermelon is the mule of the produce aisle: strong, useful, sterile, and the product of two fertile parents who go right on breeding. The American botanist O. J. Eigsti spent decades promoting the fruit to an indifferent public; seedless still held only one percent of American fresh watermelon sales in 1985. Then the shoppers decided. By 2012 seedless carried roughly ninety-two percent of the American watermelon market, a figure the industry’s own promotion board still cites today. The seeded melon lost its shelf space one shopping cart at a time, until growers stopped planting what the public stopped buying.

Here is the joke buried in the field. The seedless watermelon is the most seed-dependent crop in the patch. A triploid plant produces pollen too feeble to set fruit on its own, so growers interplant rows of ordinary diploid melons as designated pollenizers, and the bees ferry fertility from the seeded rows into the sterile ones. The triploid seed itself must be manufactured fresh every generation by repeating Kihara’s cross, much of it by hand, which makes it some of the costliest vegetable seed in the trade. An economist would look at that arrangement and smile. The grower cannot save seed from his own harvest, must buy new seed every season at a premium, and must also plant a second crop whose main job is pollination. Every seedless watermelon you have ever eaten was already a subscription product. The eater never noticed because the eater never wanted the seeds anyway; we were buying twenty uninterrupted minutes of August, and the bill for the biology stayed on the farm.

And seedlessness is old, older than any boardroom now accused of inventing it. The Thompson Seedless grape descends from the ancient sultana lineage that Persian and Ottoman growers multiplied by cuttings for centuries before California renamed it after an English immigrant. Your breakfast banana is a Cavendish, a sterile triploid propagated by dividing its shoots, which makes every Cavendish on earth close kin to every other. The navel orange traces to a single mutated branch found on a sour-orange tree near Bahia, Brazil, early in the nineteenth century; two grafted trees reached Eliza Tibbets in Riverside, California, in 1873, and one parent tree still stood there, fenced and tended, into this decade. Grafting is cloning with a pocketknife, and orchardists have practiced it since antiquity. If seedless fruit were a corporate murder weapon, the fingerprints would run back through the Ottoman vineyard to the Roman orchard. The category is acquitted. The fear, though, smelled something real before it bit the wrong ankle.

Such machinery, the kind that does separate people from their seeds, exists, and it turns one hundred years old this year. In 1926 Henry A. Wallace founded the Hi-Bred Corn Company in Des Moines to sell the first commercial hybrid corn, built on the heterosis research of George Shull and Donald Jones. An F1 hybrid crosses two inbred parent lines and captures a burst of vigor in the first generation; save that seed and plant it, and the second generation splinters back toward its grandparents, uneven, unpredictable, and down in yield. No law forbade the farmer to replant. Arithmetic forbade him. The hybrid out-yielded anything he could save by enough margin that buying fresh seed every spring became the only rational move, and within a generation the saved-seed bin, the oldest furniture in agriculture, emptied across the Corn Belt. The seed trade learned its founding lesson right there: you never need to prohibit replanting if you can make replanting worthless. Call it what it was. The first subscription model in American farming shipped in 1926, and the farmers signed up smiling, because the deal was good.

What biology started, law finished. The Plant Variety Protection Act of 1970 gave breeders their first broad rights over sexually reproduced crops while still letting farmers save seed for their own fields. Then the courts widened the door. Diamond v. Chakrabarty in 1980 held that a living organism could be patented; Ex parte Hibberd in 1985 extended full utility patents to plants; J.E.M. Ag Supply v. Pioneer Hi-Bred in 2001 saw the Supreme Court confirm that a corn variety could be patented like a carburetor, with no farmer’s exemption attached. The capstone came in 2013. Vernon Hugh Bowman, an Indiana farmer, bought cheap commodity soybeans from a grain elevator, planted them as a risky late-season second crop, and sprayed them with glyphosate, knowing most would carry Monsanto’s Roundup Ready trait because most beans in the elevator did. Monsanto sued him. The Supreme Court ruled against Bowman nine to nothing, holding that patent exhaustion, the doctrine that lets you resell or use a patented article you bought, still forbids you to manufacture new copies of it, and a planted seed is a copy machine that runs on rain. Since the middle nineties the licensed seed bag has come with a technology use agreement: grow one crop, sell it for food or feed, save nothing. There sits your subscribe-to-eat clause, printed in plain type at the dealer’s counter for thirty years, signed every spring by the people who grow your dinner.

The nightmare version of all this has a name and a patent number. In March 1998 the United States Patent Office granted patent 5,723,765, “Control of Plant Gene Expression,” jointly to the cotton breeder Delta and Pine Land and the United States Department of Agriculture. The invention described a genetic switch that would let a company sell seed whose own offspring germinate dead, a crop engineered to sterilize its next generation. Critics named it the Terminator, and the revolt was worldwide and immediate, loud enough that Monsanto, then courting Delta and Pine Land, publicly pledged in 1999 never to commercialize the technology, and the parties to the Convention on Biological Diversity adopted a de facto moratorium in 2000. The Terminator never shipped. Its shelving tells you more than its patent does. The technology was redundant. Hybrid genetics already made saved corn seed worthless, and the license agreement already made saved soybean seed illegal, so why spend money engineering sterility into a plant when a signature sterilizes the harvest at the courthouse? The gene stayed on the shelf because the contract had made it unnecessary.

Now count the hands holding the bag. Bayer bought Monsanto in 2018 for sixty-three billion dollars and retired the century-old name. Dow and DuPont merged and spun their agriculture business out as Corteva. ChemChina took Syngenta. BASF gathered the divestitures the regulators forced along the way. Four firms, by the 2025 accounting of the ETC Group and GRAIN, hold fifty-six percent of the world’s commercial seed market, with Bayer alone at twenty-three percent, and in American row crops the grip tightens further: the Department of Agriculture’s own estimates put Corteva and Bayer together at roughly seventy-two percent of United States corn seed sales and sixty-six percent of soybean seed sales. The seed arrives bundled with its herbicide, its trait license, and increasingly its software, the digital agronomy platforms that tell the farmer when to spray what he was sold. Farmers already know this shape from their tractors, where a company in Moline decides who may repair a machine the farmer believed he owned. For the commodity grower, subscribe-to-eat describes a door that closed before his father was born. He rents the genetics, licenses the chemistry, leases the data, and owns the debt.

So what does it mean that people love the seedless watermelon? It means people are honest about what a watermelon is for. Nobody in the checkout line is buying planting stock; they are buying cold pink relief on a hot day, and the seed was always the toll on that pleasure. Loving the seedless is no more a vote against the future of planting than loving a mule is a vote against horses. The gardener and the eater are the same person wearing different hats, and the hats want different things: the eater wants the seed gone from the flesh, the gardener wants the seed alive in the envelope, and a sane food culture holds both, which is why the supermarket selling the ninety-two percent seedless melon also sells, two aisles over on a wire rack, a packet of Moon and Stars watermelon seed that will breed true until the sun burns out. That love is innocent. The forgetting is the danger: forgetting that the envelope exists, and that a convenience and a condition are two different purchases.

Now run the audit the panic never runs on itself. The most famous number in the seed scare is the claim that ninety-three percent of America’s vegetable varieties vanished during the twentieth century. That figure comes from a 1983 exercise comparing the commercial seed catalogs of 1903 against the holdings of the national seed storage laboratory, and it counts the way a museum counts, by matching names on lists. When the law professor Paul Heald and the anthropologist Susannah Chapman recounted in the early 2010s, they found single varieties selling under multiple names, “lost” varieties alive under new labels, and a modern commercial catalog crop numbering in the thousands; their conclusion was that the gardener of today can buy about as much vegetable diversity as the gardener of 1903, and possibly more. Vandana Shiva’s famous indictment, that patented cotton drove hundreds of thousands of Indian farmers to suicide, collapses against the statistical record, where the statistician Ian Plewis and others found farmer suicide rates flat to declining across the years Bt cotton spread through India; debt and drought kill farmers, and the transgene never co-signed a loan. Even the seed-library scare of 2014, when Pennsylvania regulators told a Mechanicsburg lending library that sharing seeds triggered commercial seed law, ended with states writing exemptions for noncommercial exchange. The panic keeps flunking its own citations. Its one service is that it keeps a crowd staring in the general direction of a genuine enclosure.

There is one place where seedless-equals-death stops being theater and becomes epidemiology. A seed is a genetic shuffle; a cutting is a photocopy. Any crop multiplied without sex stands still while its diseases keep evolving, and the history of standing still is written in famine. Ireland planted one clonally propagated potato, the Lumper, across an entire national diet, and when Phytophthora infestans arrived in 1845 there was no genetic variation in the fields to slow it; a million people died and another million fled. The banana trade built itself on a single clone called Gros Michel until Panama disease, a soil fungus, chased it out of commercial production by the 1960s; the industry swapped in the Cavendish, another clone, and a newer strain of that fungus, Tropical Race 4, has spent two decades walking the Cavendish down the road Gros Michel already traveled. On this count the alarmists deserve the microphone. A food system of clones is a food system holding still in front of everything that eats it, and seeds, messy, spittable, recombining seeds, are the only mechanism a crop has for running.

So where does the power of the seed actually sit, and who manages it? The scholar who mapped the terrain best is Jack Kloppenburg, whose First the Seed, first published in 1988, states the whole problem in one economic observation: the seed is the only commodity that is simultaneously the product and the factory. Sell a farmer one bag and you have sold him next year’s supply, and the year after’s, forever, free. Any company wanting to sell seed annually must break that self-replication somehow, through biology, as hybrid corn did, or through law, as the utility patent and the technology agreement did, or the company has no annual business at all. Everything in this story, the 1926 hybrid, the 1970 statute, the 1998 sterility patent, the 2013 nine-justice ruling, is a variation on that single requirement. Beneath the market sits the deeper stratum, the germplasm itself: the national collections, the international crop banks, and the Svalbard Global Seed Vault, opened in 2008 inside an Arctic mountain to hold duplicate copies of the world’s crop collections. Svalbard proved its worth in 2015, when the international bank at Aleppo went inaccessible in the Syrian war and its keepers made the vault’s first withdrawal to rebuild their collection abroad. Whoever holds the germplasm holds the raw material of every future harvest, and since the Bayh-Dole era pushed American public breeding toward patents and licensing, more of that future has been drifting from the land-grant greenhouse into the corporate vault.

The counter-power sits closer to your kitchen than the doom video admits. In 1975 Diane Ott Whealy and Kent Whealy founded the Seed Savers Exchange in Iowa around two heirlooms her dying grandfather handed down, a pink German tomato and a purple morning glory his family had carried from Bavaria a century before; the exchange they built has since moved millions of samples between ordinary gardeners with no license attached to any of them. The Open Source Seed Initiative, launched in 2014 with Kloppenburg among its founders, ships seed under a pledge forbidding anyone downstream from restricting it, a copyleft for chlorophyll. And the catalogs themselves never stopped printing the free option. Open-pollinated varieties, the kind that breed true, the kind your great-grandmother saved in a coffee can, fill the pages of Baker Creek and Southern Exposure and Fedco right beside the F1 hybrids, plainly labeled, often cheaper. The home gardener’s planting future survives intact on the order form itself: choose the hybrid and you rent a season, choose the open-pollinated line and you own a lineage. That is more honest disclosure than the commodity farmer has been offered in fifty years.

Verdict time. The claim as it circulates, that seedless produce is a serving of your impending death, fails on its face; the watermelon is a sterile hybrid the shopper demanded, the banana has been seedless since long before Columbus, and the orange has been cloning itself on Riverside patience since 1873. The direction the fear points, though, holds up under oath. Seed control is real, profitable, legally armored, and a century deep, and it operates through instruments most eaters have never read: the F1 cross, the utility patent, the technology use agreement, the four-firm ledger. Your future does live in seeds. The seedless aisle was simply never where anyone kept it. Anyone wanting a stake in that future can buy one this afternoon for the price of a packet, which is the fact the doom video will never mention, because a solved problem sells no subscriptions either.

Grandpa Ott’s morning glory still grows. The variety that seeded the entire American heirloom revival, a deep purple bloom with a red star in its throat, crossed the Atlantic in a Bavarian emigrant’s luggage, survived a century of Iowa winters on one family’s fence, passed from a dying man’s hand to his granddaughter in the 1970s, and now opens every morning in thousands of gardens whose owners will never sign anything. A seed is the one technology that manufactures its own successor and charges nothing for the license. Somewhere in a kitchen drawer near you there is probably an envelope of them right now, patient as a held breath, waiting on nothing grander than dirt, water, and a person who still knows what the future looks like when it fits in the palm of a hand.
