Who Owns Your Face? DMCA and Reflexive Allegory

You may not like your face, but it belongs to you. You have an inherent, living, right to use your face as your face. You don’t need a Copyright or a Trademark on your face. You only need to wear your face and own it — warts, wrinkles, warps, and all!

This is the story of my face being stolen — for use in a ridiculous Star Trek revenge meme — and the right ending of someone on the internet who stepped forward to not just be a help to me, but to become a new friend as well.

Sitting on a Script Professor Domain Squatter

On February 6, 2012 I wrote — David W. Boles is THE Script Professor — because some unsavory person in another country created a new domain based on my ScriptProfessor.com domain by merely adding a “the” before “ScriptProfessor.com” to create “TheScriptProfessor.com” and I was outraged:

Let there be NO DOUBT on the Internets that I, David W. Boles, am, are, and forever shall beTHE Script Professor!  I have been  THE Script Professor since November 28, 2005, so let there be no question to my authenticity as pale imitators and purposeful thieves step forward and try to wrangle in private and modify in public my mark to serve their selfish ends by fogging reality and futzing legal authority.

This week, I was able to reclaim that illegally registered domain and “TheScriptProfessor.com” now rightly redirects to “ScriptProfessor.com” and the world is right and good again as you can see in this partial screenshot of some of the domains I own and operate:

Infringing on the Amazon Mark: Kindle Websites

Amazon has a winner in the Kindle e-book
and that kind of success demands imitators who want to make money off
the Kindle brand by creating source websites or fan pages by using some
form of a Kindle-ized URL.  Amazon is forced by these
pretend fans to fight them in legal letters and in a court of law, if
necessary, because to use the Kindle trademark without explicit
permission from Amazon is to infringe upon the innate rights of Amazon.
